Scapa is a site (the “site”) operated by SCAPA. By accessing or using SCAPA website and services (“our services”), you agree to comply with the terms of this permitted use policy.

CONTENT STANDARDS
These content standards apply to any and all material, which you contribute, upload or type-in to our site (“the content”), and to any interactive services associated with it. The standards apply to each part of any content as well as to its whole.
SCAPA in its sole discretion will determine whether the content meets or breaches the Content Standards.
The Content must:
- Be accurate.
- Complete and up-to-date;
- Comply with applicable laws and regulations.
The Content must not:
- Infringe any intellectual property rights, including copyright, database right or trade mark of any other person or organisation.
- Advocate, promote, incite any party to commit, or assist any unlawful or criminal act such as fraud, money laundering, or computer misuse.
- Breach any legal duty owed to a third party, such as a contractual duty
- Promote any illegal or illicit content or activity.
- Be in contempt of court.
- Be harmful to a child
- Cause any physical or psychological harm to another user directly or indirectly;
- Be defamatory, libelous, pornographic, bullying, harassing, obscene, encouraging money laundering, exploiting a child, violence, or inconsistent with applicable laws in force in Nigeria and disrupt public order;
- Be threatening, abuse or invade another's privacy, or cause annoyance, inconvenience or needless anxiety.
- Impersonate any person or misrepresent your identity or affiliation with any person.
- Give the impression that the Content emanates from us or authorized by us, except independently and validly authorized by us in express writing.
- Promote discrimination.
PROHIBITED USE
You are not permitted to use our website or services in connection with any product, service, transaction or activity that:
- violates any law or government regulation;
- is fraudulent, deceptive, unfair or predatory;
- causes or threatens reputational damage to us;
- involves any of the business categories listed in restricted businesses;
- results in or creates a significant risk, penalties, damages or other harm or liability.
- To send, upload, download, use or re-use any material which does not comply with our content standards.
- To transmit, or procure the sending of, any unsolicited or unauthorised material or any other form of similar solicitation (spam).
- To knowingly transmit any data, send or upload any material that contains viruses, trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.

PROHIBITED BUSINESS CATEGORIES/MERCHANTS
The following businesses and merchants are prohibited from using SCAPA services. Business in connection with any product, service, transaction or activity that:
falls within the Prohibition List of the Nigerian Customs Administration of the Federal Republic of Nigeria;
relates to the sale and/or purchase of:
- banned narcotics, steroids, certain controlled substances or other products that present a risk a consumer's safety;
- blood, bodily fluids or body parts;
- burglary tools
- counterfeit items;
- illegal drugs and drug paraphernalia;
- fireworks, destructive devices and explosives;
- identity documents, government documents, personal financial records or personal information (in any form, including mailing lists);
- lottery tickets, sweepstakes entries or slot machines without the required license;
- offensive material or hate speech or items that promote hate, violence, racial intolerance, or the financial exploitation of a crime;
- chemicals;
- recalled items;
- prohibited services;
- unlicensed financial services, stocks or other securities;
- stolen property;
- xv.items that infringe or violate any copyright, trademark, right of publicity or privacy or any other proprietary right under the laws of any jurisdiction;
- xvi.sales of currency without BDC licence, cryptocurrency operators;
- xvii.obscene material or pornography;
- xviii.certain sexually oriented materials or services;
- xix.certain firearms, firearm parts or accessories, ammunition, weapons or knives;
- xx.any product or service that is illegal or marketed or sold in such a way as to create liability to us; or
- xxi.production of military and paramilitary wears and accoutrement, including those of the Police and the Customs, Immigration and Prison Services.
POLICY VIOLATION
If, in our sole discretion, we believe that you may have engaged in any violation of this permitted use policy, we may (with or without notice to you) take such actions as we deem appropriate to mitigate risk to SCAPA and any affected third parties and to ensure compliance with this permitted use policy. Such actions may include, without limitation:
- i.Suspending, restricting or terminating your access to and use of the SCAPA’s Services;
- ii.Immediate, temporary or permanent removal of any content uploaded by you;
- iii.Terminating our business relationship with you, including termination without liability to SCAPA;
- iv.Taking legal action against you for reimbursement of all costs, liabilities, damages, and/or claims (including, but not limited to, reasonable administrative and legal costs) resulting from the breach;
- Contacting and disclosing information related to such violations to
- persons who have sold/purchased goods or services from you;
- any banks involved with your business or transactions;
- law enforcement or regulatory agencies; and
- other third parties that may have been impacted by such violations; or
- Assessing against you any fees, penalties, assessments or expenses (including reasonable attorneys’ fees) that we may incur as a result of such violations, which you agree to pay promptly upon notice.
CHANGES TO THIS POLICY
SCAPA reserves the right to update, modify or amend this Permitted Use Policy as our technology and services evolves and/or as required by business or legal requirements. Updates to this Permitted Use Policy will be made available on our website
GOVERNING LAW
These Terms of Service shall be interpreted and governed by the laws currently in force in the Federal Republic of Nigeria.
